1. About This Notice

Vision Group, Inc. (“Vision Group”, “we”, “us” or “our”) is committed to protecting the privacy of your personal information. This Privacy Notice explains what personal information we collect, why we collect it, how we use and share it, how long we keep it, and the rights available to you.

This Notice applies to websites owned and controlled by Vision Group that link to it, to the Vision Group applications and services we make available (together, the “Vision Group Services”), and to our mobile applications. It does not apply to third-party websites or services that we do not control; we encourage you to review their privacy notices separately.

Where Vision Group processes personal information on behalf of a customer as part of delivering the Vision Group Services, we act as a processor and that processing is governed by our agreement with that customer. This Notice describes processing for which Vision Group acts as controller.

2. Who We Are

Vision Group, Inc. is the controller of the personal information described in this Notice.

3. Personal Information We Collect

3.1 Information you provide to us

  • Identity and contact details, including your name, email address, telephone number, job title and employer, provided when you request information, register for an account, subscribe to communications or contact us.
  • Account credentials, including the username and password used to access your account. Passwords are stored in hashed form and are used solely to provide access to your account.
  • Content you submit, including information entered into the Vision Group Services, support requests and any testimonial you agree to provide.

3.2 Information collected automatically

  • Usage information, including the time, frequency, duration and pattern of your use of the Vision Group Services, features accessed and storage consumed.
  • Device and technical information, including IP address, browser type and language, referring URL, files accessed, errors generated, time zone, operating system, device type and mobile carrier.
  • Location information, where our mobile application uses location services on your device and you have granted the relevant permission.
  • Cookies and similar technologies, as described in section 6.

3.3 Information we receive from other sources

In some circumstances we receive personal information about you from a source other than you. Section 4 sets out those sources.

4. Sources of Personal Information

Where we do not collect personal information directly from the individual concerned, we obtain it from the following sources:

Where personal information is provided to us by a customer, that customer is responsible for having an appropriate lawful basis for providing it to us and for informing the individuals concerned.

5. How We Use Personal Information and Our Legal Bases

We use personal information for the purposes set out below. Where the General Data Protection Regulation applies, the legal basis for each purpose is stated.

Where we rely on legitimate interests, we have assessed that those interests are not overridden by your interests or fundamental rights. You may object to such processing as described in section 10.

6. Cookies and Similar Technologies

We use session and persistent cookies to operate our websites and improve your experience. Session cookies are removed when you close your browser. Persistent cookies allow us to remember your preferences, including where you choose to remain signed in.

We may also use pixel tags and similar technologies to measure website traffic and analyse performance. We may engage third parties to analyse aggregated statistical information about our websites; that information is not personally identifiable and we do not have access to cookies set by those parties.

If you disable cookies, some parts of our websites and services may not function correctly.

7. How We Share Personal Information

We do not sell personal information, and we do not share personal information for cross-context behavioural advertising.

We disclose personal information only as follows:

  • To affiliates, service providers and business partners who process personal information on our behalf to deliver the Vision Group Services. These parties are bound by contract to appropriate confidentiality and security obligations and may process personal information only on our instructions.
  • To our customers, where the personal information relates to their authorised users of the Vision Group Services.
  • Where you have given us your specific consent to do so.
  • To law enforcement or regulatory authorities where we are required to do so by law or in response to a valid legal process, or where we consider disclosure necessary to protect the safety of our users, our personnel or the public.
  • To a purchaser or successor entity in connection with a merger, acquisition or sale of assets, subject to the protections described in this Notice.

We may share aggregated or de-identified information that cannot reasonably be used to identify you.

8. International Transfers and Data Location

Vision Group operates from the United States and delivers the Vision Group Services using cloud infrastructure located in the United States and the European Union.

Personal information relating to customers established in the European Economic Area is hosted in a European Union region. Where personal information is transferred outside the European Economic Area or the United Kingdom, we implement an appropriate transfer mechanism, including standard contractual clauses approved by the European Commission, together with supplementary technical measures such as encryption in transit and at rest.

9. Data Retention

We retain personal information only for as long as necessary for the purposes for which it was collected, including to satisfy legal, accounting, regulatory or reporting requirements.

  • Account information is retained for the duration of the account relationship and for a defined period afterwards to support reactivation and to meet legal obligations.
  • Personal information processed on behalf of a customer is retained in accordance with the applicable customer agreement and deleted or returned on termination or on the customer’s instruction.
  • System and security logs are retained in accordance with our information security policies.
  • Marketing contact details are retained until you withdraw consent or object to further contact.

Backup copies are retained for defined periods and are overwritten in the ordinary course. As a result, information may persist in backups for a limited period following deletion from active systems.

10. Your Privacy Rights

10.1 Rights under the General Data Protection Regulation

If you are located in the European Economic Area or the United Kingdom, you have the following rights in relation to your personal information:

  • Access — to obtain confirmation of whether we process your personal information and to receive a copy of it.
  • Rectification — to have inaccurate personal information corrected and incomplete information completed.
  • Erasure — to have your personal information deleted in certain circumstances.
  • Restriction — to request that we restrict processing in certain circumstances.
  • Portability — to receive personal information you provided to us in a structured, commonly used and machine-readable format, and to have it transmitted to another controller where technically feasible.
  • Objection — to object to processing carried out on the basis of legitimate interests, and to object at any time to processing for direct marketing.
  • Withdrawal of consent — to withdraw consent at any time where processing is based on consent. Withdrawal does not affect processing carried out before withdrawal.
  • Complaint — to lodge a complaint with your local supervisory authority.

10.2 Rights under the California Consumer Privacy Act

If you are a California resident, you have the right to know what personal information we collect, use, disclose and retain; to request deletion of your personal information; to request correction of inaccurate personal information; to opt out of the sale or sharing of personal information; and not to be discriminated against for exercising any of these rights. As stated in section 7, we do not sell personal information and do not share it for cross-context behavioural advertising.

10.3 How to exercise your rights

To exercise any of these rights, contact us at privacy@visiongroupretail.com. We will respond within the period required by applicable law and in any event within 30 days of receipt. We may need to verify your identity before acting on a request, and will limit that verification to what is necessary.

If your personal information is processed by Vision Group on behalf of one of our customers, we will refer your request to that customer and support them in responding to it.

11. How We Protect Personal Information

We maintain technical, organisational and physical safeguards designed to protect personal information against unauthorised access, alteration, disclosure or destruction. These include encryption of data in transit and at rest, role-based access control with multi-factor authentication, network segmentation, security monitoring, and independent security testing.

Access to personal information is restricted to personnel who require it to perform their role and who are subject to confidentiality obligations.

No method of transmission or storage is completely secure. If we become aware of a personal data breach affecting your information, we will notify you and the relevant authorities where required to do so by law.

12. Children’s Privacy

The Vision Group Services are business services and are not directed to children. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will delete it.

13. Changes to This Notice

We may update this Notice from time to time. The version number and effective date at the top of this Notice indicate when it was last revised.

Where we make a material change to how we collect or use personal information, we will provide notice by email or by a prominent notice on the relevant Vision Group website before the change takes effect, and where required we will offer you a choice about the new use. Minor changes will be published without separate notification. We encourage you to review this Notice periodically.
